On July 1, 2019, protections were expanded in the Corporations Act 2001 to give certain individuals legal rights and protections as whistleblowers. As part of the act, “large” public companies, proprietaries, and corporate trustees of APRA-regulated superannuation entities are required to have a whistleblower reporting policy in place as of January 1, 2020. If a company fails to implement a policy or handles a whistleblower report incorrectly, they could face severe criminal offenses and civil penalties for this misconduct. Whistleblowers can also seek compensation through court if they suffer a loss, damage or injury for making a report.

BC PIDA Compliance Management Solutions

The PIDA legislation provides a framework for employees to report specific misconduct without reprisal, but this alone isn’t enough. It’s your responsibility to implement the necessary tools and guidelines to ensure your employees know how to report misconduct, and that your compliance team knows what to do with that information. Doing this on your own can be costly and time consuming, which is why businesses continue to turn towards third-party whistleblowing case management solutions.

European Union Whistleblower Directive Compliance Management Solutions

Each of the 27 EU member states will need to transcribe the directives into their own national law. The new EU whistleblower directive impacts thousands of companies across the EU with more than 50 employees and requires them to create internal reporting system to help employees and other third parties report violations of EU law and to protect those who do report from retaliation when they speak-up. Companies with over 250 employees will need to ensure they are compliant with the new regulations by the end of the year.

Whistleblowers should be able to submit reports via an online system, a hotline number, or via mail. Companies must also ensure that the identity of the whistleblower is kept confidential no matter the mechanism that is used to file the report.

Bill 198 (Multilateral Instrument 52-110) in Canada and Section 301.4 of the Sarbanes-Oxley Act require all publicly traded companies to: ‘Establish procedures for the receipt, retention, and treatment of complaints received regarding accounting, internal accounting controls, or auditing matters; and handling the confidential, anonymous submission by company employees of concerns regarding questionable accounting or auditing matters’. Our IntegrityCounts reporting system provides not only a confidential and anonymous reporting system for employees and other stakeholders, it also provides a valuable source of information regarding the organization’s Code of Conduct and Ethics and the Reporter’s role and responsibilities.

What happens to the information I provide?

The information you provide is available immediately to the authorized designates from your organization who have been set up to receive reported complaints. The reviewers will assess each reported complaint and decide what actions are appropriate. When filing the complaint, you will be able to see who has access to it.
